FDA Warning Letter to Empower Pharmacy Says Compounded GLP-1 Combination Products Were Essentially Copies
On September 18, 2026, the FDA issued a warning letter to Empower Clinic Services, LLC, doing business as Empower Pharmacy, in Houston. The letter followed a November 2025 inspection of the firm.
The FDA stated that Empower's tirzepatide/niacinamide and semaglutide/cyanocobalamin, or vitamin B12, products appear to be essentially copies of FDA-approved semaglutide and tirzepatide products. The agency said the products were compounded regularly and in inordinate amounts.
The letter went further on intent. The FDA stated that the production volume suggested the claimed differences from the approved products were pretextual, and that the products therefore did not meet the conditions of section 503A.
This letter is the clearest FDA application, to a named compounder, of the essentially a copy standard the agency clarified on April 1, 2026. Readers can compare the two posts: the April post explains the standard, and this post shows the FDA applying it to a specific firm and specific combination products.
The letter also cited sterile production and manufacturing practice deficiencies. A warning letter is not a ban on the firm or a recall, and the FDA directed a response within 15 working days. Compounded products are not FDA-approved, and the approval of a brand-name product applies only to that product and its labeled indication.
